Position of the Ukrainian Orthodox Church within the Russian Orthodox Church: The Aspects of Canon Law

Abstract

In this paper, we consider the status of the Ukrainian Orthodox Church within the Russian Orthodox Church. Through analysis of the most important canonical legal documents relating to the Ukrainian Orthodox Church, we are trying to explain the position of the Ukrainian Orthodox Church within the Russian Orthodox Church. Also, in this paper we are trying to explain the term as broad autonomy of the Ukrainian Orthodox Church, as well as terms independence, autonomy and self–government of the Ukrainian Orthodox Church. The first part of this paper is focused on the analysis of official documents that define the status of the Ukrainian Orthodox Church within the Russian Orthodox Church and those are the following documents: Decision of the Council of Bishops of the Russian Orthodox Church concerning the Ukrainian Orthodox Church (the decision was made on October 27, 1990), Decree of the Moscow patriarch Alexei II addressed to metropolitan of Kiev Filaret Denisenko, Constitution of the Ukrainian Orthodox Church, Constitution of the Russian Orthodox Church. The second part of the paper is devoted to a comparative analysis of the status of the Ukrainian Orthodox Church and other Churches that are part of the Russian Orthodox Church. The aim of this paper is to show the special status of the Ukrainian Orthodox Church within the Russian Orthodox Church and to point out the exceptional importance of the Ukrainian Orthodox Church for the Russian Orthodox Church.
